The innovations in the Telematic Criminal Trial introduced by the Technical Specifications of the DGSIA Provision of 2 August 2024

25-08-2024

On 7 August 2024, the new technical specifications relating to the electronic civil process were published on the Telematic Services Portal of the Ministry of Justice, replacing those of 14 April 2014.

The new Provision is characterized, first of all, by a general reorganization with the suppression of the “bis” and “ter” numbering of some provisions, with the attribution to the articles of a unique consecutive cardinal numbering. As a result of these changes, for example, the rules that regulated in the old provision, respectively, the electronic notifications of lawyers and the separate certificates of conformity, i.e. Articles 19-bis and 19-ter, are now transposed into Articles 26 and 27.

The most relevant and substantial changes are, however, others, and can be divided into three groups:

  • the expansion of the maximum dimensions of electronic envelopes;
  • the expansion of the range of document formats susceptible to electronic filing;
  • the automatic acceptance of some electronic filings.
