Acquitted of vehicular homicide by the Varese Preliminary Hearing Judge

The Varese Preliminary Hearing Judge (GUP) has acquitted a man, represented by lawyers Fabrizio Busignani and Vincenzo Toscano, of vehicular homicide in connection with the accident that occurred in Induno Olona, along Via Valganna SS233, on the evening of August 5, 2024.

The man was accused, as a motorcycle driver, of causing the death of a woman, who died more than a month later due to a serious deterioration in her medical condition following a fall while crossing the road.

According to the charges, the motorcyclist was allegedly driving while impaired by alcohol, with a blood alcohol level of 0.58 g/l, and failed to adjust his driving style to nighttime conditions, limited visibility, and the curved shape of the road.

The acquittal was reached following in-depth technical investigations into the accident dynamics. Specifically, the kinematics report produced by the defense reconstructed the scene of the accident, highlighting the poor visibility of the road, the pedestrian crossing in an area without lines and with a diagonal trajectory, and the extremely limited time the driver had to perceive the danger and react.

The technical reconstruction revealed that the motorcycle was traveling at a low speed, estimated at approximately 45 km/h, and that the pedestrians would have become visible only when they were within the light cone of the headlight, a very short distance away. The report also ruled out any objective evidence consistent with a collision between the left mirror and the woman, highlighting the absence of damage or deformations consistent with such contact.

The defense's argument, accepted in the proceedings, therefore maintained the motorcyclist's complete lack of responsibility for the accident, attributing the accident to a sudden crossing of the road, in conditions of severely limited visibility and with no concrete possibility of avoiding the incident.

The acquittal by the Varese preliminary hearing judge thus concludes the preliminary phase of the proceedings, recognizing the absence of criminally relevant negligence on the part of the defendant.
