Acquitted from the charge of road homicide by the Court of Pavia following the trial
30-09-2024
Not guilty of the death of an elderly lady who was hit on the pedestrian crossing in Pavia in via Tasso while crossing the street on the morning of October 18, 2022 and then died after twenty days of agony at the San Matteo in Pavia.
On September 30, 2024, the Pavia Court in a single-judge composition, in the person of Judge Dr. Giulia Eleonora Aresini, acquitted "because the fact does not constitute a crime", the only defendant L.V., a 79-year-old from Pavia who was driving the Volkswagen Passat that after being hit by a rear-end car, hit the pensioner "loading" her onto the windshield for about twenty meters, ending up crashing into a car parked illegally on the opposite side of via Tasso.
The Public Prosecutor had requested a sentence of 1 year and 4 months of imprisonment for Lina Venco. But the judge, after the council chamber, pronounced the acquittal.
«It was clear from the beginning that Mrs. V. had stepped on the accelerator, while she was stopped at the pedestrian crossing, because she had been hit by a rear-end collision: it was an instinctive reaction and her car had an automatic transmission - explains the defendant's lawyer, Fabrizio Busignani from Varese -. Without that rear-end collision, as emerged in the trial and in the expert reports, L. V.'s car would have remained stationary». The judge's reasons will be filed in the coming weeks, but evidently the magistrate Aresini accepted the defense's thesis, acquitting the 79-year-old. «In addition, the Cadillac that had hit the car had been fined by the local police of Pavia, while the fine to L.V. had been suspended by the Justice of the Peace pending the criminal proceedings» concludes the defendant's lawyer.
