We assist our clients in the creation and implementation of organizational models according to the provisions of legislative decree n. 231/2001.
The members of the Firm have acquired great experience in the realization of Organizational Models envisaged by the above mentioned Decree, with a personalized path to be defined with the individual companies which is divided into different phases:
- Detailed analysis of risk areas (sensitive) by examining company documents, procedures and targeted interviews
- Definition of a system of rules necessary for the possible implementation of the O.M. and the procedures to be adopted in the areas identified as "sensitive"
- Harmonisation of any existing procedure with the provisions of the legislative decree n. 231/01
- Assignment to a Supervisory Body of specific tasks for monitoring the effectiveness and correct functioning of the Model and its constant updating
- Possible identification of the components of the SB, in any case no fewer than three, to ensure that they have an adequate knowledge of the regulatory system, with adequate autonomy, independence, professionalism and continuity of action, necessary for the performance of their functions
- Introduction of a specific disciplinary system that provides for sanctions in case of non-compliance with the provisions of the Model
- Introduction of a staff training system with representation functions and verification of the appropriateness of the training of employees aimed at the functionality of the model.
Experience
Busignani Law Firm is able to offer specialized assistance in relation to the prevention of all crimes covered by Legislative Decree 231/01 on the administrative liability of legal entities, through an in-depth study of company processes, in order to prepare the so-called "Organizational Models", contemplated by Legislative Decree 231/01, to avoid the application of the severe sanctions provided for by the aforementioned Law.
