On March 6, the Judge of Preliminary Investigations of the Court of Busto Arsizio accepted the request of the deputy prosecutor Nicola Rossato and seized numerous movable and immovable assets from some entrepreneurs involved in an investigation by the Guardia di Finanza of Gallarate for tax fraud.
According to the investigators, thanks to false invoices and related non-existent credits, the companies involved secured a significant competitive advantage, being able to make cheaper offers than those of competitors on the market.
The calculated tax evasion is around 25 million euros. Among the suspects, six were subject to precautionary custody orders: a tax consultant and another professional with whom he collaborated ended up in prison, two entrepreneurs between Bergamo and Brescia are under house arrest, two others (including a woman) are subject to the residence obligation.
The judges of the Varese Review Court, on the other hand, dismantled part of the work done by colleagues from Busto Arsizio and released 4 properties belonging to a couple of entrepreneurs from Gallarate: these are two shares of as many properties, two entire properties and the share capital.
The defender Fabrizio Busignani argued that neither the prosecutor nor the investigating judge in any way justified the alleged impossibility of proceeding with the direct seizure, taking into account the impossibility of finding in the assets of the various legal persons assets constituting the profit of the crime, including those possibly fruit of the immediate reuse of the money certainly susceptible to direct confiscation.
Finally, Busignani also expressed his satisfaction for the release from seizure obtained: «It was a clear injustice - explains the lawyer - the provision was simply illegitimate. My clients are asking to be heard by the prosecutor since the first search that dates back to 2015 ".
