The new Confindustria guidelines for organizational models pursuant to Legislative Decree 231/01
08-07-2021
A few years after the last edition, Confindustria obtained approval from the Ministry of Justice of the new version of the Guidelines for the adoption of organisational models pursuant to Legislative Decree 231/01.
The new guidelines constitute an indication of a methodological nature for the construction of organisation, management and control models as a safeguard against the predicate offences envisaged by the Decree.
The new guidelines take into account the new whistleblowing discipline as well as the new laws in force, including the so-called Corrupt Sweeps Law.
Of particular interest is the suggestion to go beyond traditional compliance systems to foster integrated compliance so that activities can be rationalised (in terms of resources, people, systems, etc.), improve the effectiveness and efficiency of compliance activities and facilitate the sharing of information through an integrated vision of the various compliance needs, also through the execution of joint risk assessments, and the periodic maintenance of compliance programs (including the methods of managing financial resources, as relevant and suitable for preventing commission of many of the offences expressly envisaged as founding the liability of entities).
