Fabrizio Busignani in the annulment of a conviction on appeal by the Court of Cassazione

The Third Criminal Section of the Court of Cassazione today overturned a conviction issued by the Milan Court of Appeal, which had overturned a first-instance decision by the Busto Arszio Court acquitting a man, represented by Attorney Fabrizio Busignani, who had been wrongly accused of a serious sex crime.
Following the first-instance trial in January 2023, the man was acquitted of the most serious of the charges he was accused of, resulting in the immediate release of the 50-year-old, who had been in prison since October 2021, when he was arrested by Carabinieri officers from the Tradate police station.
In upholding the appeal filed against the overturning ruling by the Regional Court, the Court of Cassazione assessed the grounds for the appeal, reserving the right to file its reasons within the statutory time limit.
