The Court of Varese, upholding the claims for damages filed by Attorney Fabrizio Busignani, ordered a Local Health Authority (ASST) to pay damages totaling over one million euros to the relatives of a victim of medical malpractice.
The complex and nuanced legal proceedings involved a failed diagnosis of cancer and the subsequent failure to treat the tumor, resulting in an unjustifiable delay.
The ruling established that a timely and accurate diagnosis and a proper therapeutic approach to the tumor from the outset would more likely than not have allowed the patient to recover without or with minimal after-effects.
The Court found that the improper medical care had therefore deprived the patient of a 50% chance of achieving the desired outcome, based on the medical knowledge of the time, and consequently ordered the relatives to pay damages.
